Terms and Conditions
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Services.
If you are accessing the Services through an institutional license (for example, through a university, workforce agency, nonprofit, or employer), your institution's agreement with Big Interview ("Institutional Agreement") may contain additional or different terms. In the event of any conflict between these Terms and an Institutional Agreement, the Institutional Agreement governs.
1. Services Overview
Big Interview provides a suite of career readiness and employment preparation tools, including:
- Big Interview: video-based curriculum, AI-powered interview practice, and coaching workflows for interview preparation.
- Big Resume: resume building tools and AI-powered resume feedback and optimization.
- Big Interview Medical: residency interview preparation tools designed for medical students and graduates.
- Additional features and products that we may introduce from time to time.
We reserve the right to modify, update, or discontinue any aspect of the Services at any time. We will provide reasonable notice of material changes where practicable.
2. Eligibility and Account Registration
2.1 Eligibility
The Services are not directed to or intended for children under the age of 13. You may not create or use a consumer account if you are under 13. If you are between 13 and 17, you may use the Services only through an institutional customer (such as a school or educational program) that has authorized your use; in that case, your institution is responsible for any required parental or guardian consent. By creating a consumer account, you represent that you are at least 18 years old.
2.2 Account Information
When you create an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the accuracy of your account information and for updating it promptly if anything changes.
2.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@biginterview.com if you believe your account has been compromised.
2.4 Institutional Access
If your access to the Services is provided through an institution, your use may be subject to additional terms established between that institution and Big Interview. Your institution's administrators may have access to your usage data, activity records, and other information as described in our Privacy Policy and the applicable Institutional Agreement.
3. AI-Powered Features
3.1 Nature of AI Features
The Services include AI-powered features, including but not limited to:
- Interview practice with AI feedback (VideoAI): analyzes your practice interview recordings and provides feedback on delivery, content, clarity, pacing, filler words, positioning, eye contact, and other aspects of interview performance.
- Resume feedback (ResumeAI): analyzes your resume and provides scoring and improvement suggestions across readability, credibility, and formatting dimensions.
- Personalized question generation: generates interview questions tailored to your target role, job description, and resume.
3.2 AI Limitations and Disclaimers
AI-generated feedback, scores, suggestions, and other outputs ("AI Outputs") are provided for informational and educational purposes only. You acknowledge and agree that:
- AI Outputs are not a substitute for professional career coaching, legal advice, or human judgment.
- AI Outputs may contain inaccuracies, errors, or incomplete assessments. You should exercise your own judgment before acting on any AI Output.
- Big Interview does not guarantee that following AI recommendations will result in employment, improved interview performance, or any specific outcome.
- AI features may change, improve, or be updated over time, and the feedback you receive may differ between sessions.
- AI Outputs do not make hiring, admissions, employment, eligibility, licensing, or other legally significant decisions about any user.
3.3 AI Data Processing
When you use AI-powered features, the Services process your content (including video recordings, audio, text responses, and resume content) to generate AI Outputs. For details on how we collect, use, store, and protect this data, please refer to our Privacy Policy.
3.4 Acceptable Use of AI Features
When using AI-powered features, you agree not to:
- Submit content intended to probe, test, or exploit the AI system's behavior, or attempt to extract underlying model information.
- Use AI feedback to prepare deceptive, fraudulent, or misleading representations to prospective employers or other parties.
- Rely on AI Outputs as the sole basis for decisions that carry significant professional, legal, or financial consequences without independent human review.
- Submit content that contains malicious code, harmful material, or content that violates these Terms.
3.5 AI Training Data
We do not use your User Content to train third-party general-purpose artificial intelligence or large language models, and our agreements with AI service providers prohibit those providers from doing so. We may use de-identified and aggregated data, and your User Content as needed, to operate, monitor, secure, and improve the Services.
4. Your Content
4.1 User Content
You may create, upload, or provide information, data, video recordings, resumes, text responses, and other materials through the Services ("User Content"). You retain ownership of your User Content, subject to the license granted below.
4.2 License to Big Interview
By submitting User Content to the Services, you grant Big Interview a non-exclusive, worldwide, royalty-free license to use, store, process, reproduce, and display your User Content solely for the purposes of providing, maintaining, and improving the Services. This license continues for as long as your User Content is stored on our systems and terminates when your User Content is deleted in accordance with our data retention practices.
4.3 Your Responsibilities
You represent that you have all necessary rights to submit your User Content and that your User Content does not infringe or violate the rights of any third party. You agree that your User Content will not contain material that is unlawful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
4.4 Storage and Retention
Each user may store up to 1 GB of audio and video recordings on Big Interview's servers. We reserve the right to adjust this limit. The following retention practices apply:
- Video and audio recordings: recordings that have not been accessed in more than 12 months may be removed at our discretion.
- Resume data: resume content submitted through Big Resume is retained for as long as your account is active, unless you delete it earlier.
- AI-generated feedback: feedback, scores, and other AI Outputs associated with your sessions are retained for as long as your account is active.
- Account deletion: when you delete your account, all associated User Content, including recordings, resumes, and AI feedback history, will be deleted in accordance with our Privacy Policy. Backup copies may be retained for a limited period thereafter.
4.5 Backup Responsibility
You are responsible for maintaining your own backup copies of User Content. Big Interview is not liable for the loss, corruption, or deletion of User Content for any reason.
5. Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:
- Use the Services in any way that violates applicable federal, state, local, or international law or regulation.
- Send unsolicited communications through the Services.
- Interfere with or disrupt the Services, or attempt to gain unauthorized access to any part of the Services.
- Use the Services to harm, threaten, harass, stalk, or abuse any person.
- Post, transmit, or distribute defamatory, obscene, or otherwise objectionable material.
- Attempt to reverse engineer, decompile, or disassemble any part of the Services.
- Use automated tools, bots, or scripts to access or interact with the Services without our prior written consent.
- Resell, sublicense, or otherwise provide access to the Services to any third party, except as expressly permitted by an Institutional Agreement.
6. Intellectual Property
6.1 Big Interview Property
All content, software, technology, designs, graphics, videos, curriculum, AI models, and other materials provided through the Services ("Big Interview Property") are owned by Big Interview or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, lease, or create derivative works based on Big Interview Property, in whole or in part, without our prior written consent.
6.2 Trademarks
Big Interview, Big Resume, Big Interview Medical, and all related logos, product names, and service names are trademarks of Skillful Communications, Inc. You may not use these marks without our prior written permission.
6.3 Feedback
If you provide suggestions, ideas, or other feedback about the Services ("Feedback"), you grant Big Interview a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into the Services without any obligation to you.
7. Payment, Refunds, and Cancellation
7.1 Fees
Access to certain features of the Services requires payment. By purchasing a subscription or other paid access, you agree to pay all applicable fees as described at the time of purchase.
7.2 Recurring Subscriptions
If you purchase a recurring subscription, your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for the renewal fee at the then-current rate.
7.3 Refunds
If you are not satisfied with your purchase, you may request a refund within 30 days of your initial purchase by contacting support@biginterview.com. After the 30-day window, refunds are provided at Big Interview's discretion. Refunds for institutional or enterprise subscriptions are governed by the applicable Institutional Agreement.
7.4 Taxes
You are responsible for any applicable taxes associated with your use of the Services.
8. Term and Termination
8.1 Term
These Terms are effective when you first access or use the Services and remain in effect until terminated.
8.2 Termination by You
You may terminate your account at any time by deleting your account through your account settings or by contacting support@biginterview.com.
8.3 Termination by Big Interview
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, if we believe your use violates these Terms or if we determine that termination is necessary to protect the Services, our users, or Big Interview.
8.4 Effect of Termination
Upon termination, your right to access the Services ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute resolution.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. BIG INTERVIEW DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing:
- Big Interview does not warrant that the Services will be uninterrupted, error-free, or secure.
- Big Interview does not warrant the accuracy, completeness, or reliability of any AI-generated content, feedback, scores, or recommendations.
- Big Interview does not guarantee any specific employment outcomes, interview results, or career advancement from use of the Services.
- No oral or written information or advice provided by Big Interview creates any warranty not expressly stated in these Terms.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIG INTERVIEW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF EMPLOYMENT OPPORTUNITIES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF BIG INTERVIEW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIG INTERVIEW'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO BIG INTERVIEW IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
11. Indemnification by User
You will defend, indemnify, and hold harmless Big Interview, its affiliates, and their respective officers, directors, employees, and agents from and against any claim, demand, loss, damage, cost, or expense, including reasonable attorneys' fees, arising from or related to (a) your User Content, (b) your use of or access to the Services, (c) your violation of these Terms, or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right. This indemnification obligation does not apply to the extent the claim is caused by Big Interview's gross negligence or willful misconduct. Big Interview reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense. Your obligations under this Section 11 survive termination of these Terms.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
12.2 Informal Dispute Resolution
Before initiating arbitration, the party asserting a claim must send a written Notice of Dispute to the other party describing the nature of the claim and the relief sought. Notice to Big Interview must be sent to legal@biginterview.com and to our mailing address listed in Section 18. The parties will attempt in good faith to resolve the dispute informally for sixty (60) days following Notice. Arbitration may be initiated only if the dispute remains unresolved after that period. Any applicable statute of limitations is tolled during the informal resolution period.
12.3 Binding Arbitration
Subject to Section 12.2, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its then-current rules, including the Consumer Arbitration Rules where applicable. The arbitration will be conducted in New York, New York, by one arbitrator. The arbitrator will apply New York law. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
12.4 Arbitration Opt-Out
You may opt out of this arbitration agreement by sending written notice to legal@biginterview.com within thirty (30) days of first accepting these Terms. Your opt-out notice must include your name, the email address associated with your account, and a clear statement that you are opting out of arbitration. Opting out does not affect any other provision of these Terms.
12.5 Class Action Waiver
YOU AND BIG INTERVIEW AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
12.6 Mass Arbitration
If twenty-five (25) or more substantially similar arbitration demands are filed against Big Interview by or with the coordination of the same law firm or counsel, all such demands will be administered in sequential batches of no more than fifty (50) demands at a time. Subsequent batches will not commence until prior batches conclude. Filing fees and arbitrator fees for batched proceedings will be apportioned among the demands in each batch by the arbitrator. The parties consent to a single arbitrator presiding over each batch. The parties will work in good faith with AAA to implement this batching process and to avoid duplicative fees and proceedings.
If a court of competent jurisdiction or arbitrator finds this Section 12.6 unenforceable in any material respect with respect to a particular set of demands, then the arbitration agreement in this Section 12 will be unenforceable as to those demands, and those disputes will instead proceed in court, subject to the class action waiver in Section 12.5 and the other provisions of these Terms. The remainder of these Terms, including all other provisions of this Section 12, will continue in full force and effect.
12.7 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights. Either party may also bring qualifying claims in small claims court.
12.8 Attorneys' Fees
In any arbitration or legal proceeding arising from these Terms, the prevailing party will be entitled to recover its reasonable attorneys' fees and costs to the extent permitted by applicable law.
13. Modifications to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Post the updated Terms on biginterview.com/terms with a revised "Last Updated" date.
- Provide notice via email to the address associated with your account at least 30 days before material changes take effect, or by other reasonable means.
Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you should stop using the Services and delete your account.
14. Accessibility
Big Interview works to make the Services usable by people with a wide range of abilities and aims to align with applicable accessibility guidelines as a goal. If you experience an accessibility barrier, please contact us at support@biginterview.com so we can work to address it.
15. Copyright Complaints (DMCA)
Big Interview respects the intellectual property rights of others. If you believe content on the Services infringes your copyright, please send a notice to our designated agent that includes the information required by the Digital Millennium Copyright Act, including:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and information sufficient to allow us to locate it.
- Your contact information.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-notification procedures are available to users whose content is removed; contact the designated agent for instructions. We may terminate the accounts of repeat infringers.
16. Government End Users
The Services are "Commercial Computer Software" and "Commercial Computer Software Documentation," as those terms are defined in 48 C.F.R. § 2.101. U.S. Government end users acquire the Services with only those rights set forth in these Terms, consistent with FAR 52.227-19 and DFARS 227.7202, as applicable. Use, duplication, or disclosure by the U.S. Government is subject to the restrictions in these Terms.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any applicable Institutional Agreement, constitute the entire agreement between you and Big Interview regarding the Services.
17.2 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. Big Interview may assign its rights and obligations under these Terms without restriction.
17.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17.4 Waiver
The failure of Big Interview to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
17.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
17.6 Force Majeure
Neither party will be liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, pandemics, government action, internet or telecommunications outages, denial-of-service attacks, or third-party service failures. This Section 17.6 does not excuse payment obligations.
17.7 Notices
We may provide notices to you by email to the address associated with your account, by in-product notice, or by posting on biginterview.com. You may provide notices to us by email to legal@biginterview.com or by mail to the address in Section 18.
17.8 Service Levels
Any service level commitments, uptime targets, or service credit obligations apply only as expressly set forth in an applicable Institutional Agreement between Big Interview and an enterprise or institutional customer. These Terms do not create any service level commitment to consumer subscribers or other users, and the Services are provided as described in Section 9 (Disclaimers).
